Por causa de fuerza mayor se entiende lo establecido por el Código Civil español y por la jurisprudencia de los juzgados y tribunales españoles.

En caso de cancelación, de anulación o de modificación sustancial del Festival, la devolución se deberá efectuar por la plataforma de venta de entradas donde hayas adquirido la entrada, dentro del plazo establecido según la legislación vigente en ese momento. Así mismo, la Organización establecerá un periodo de tiempo determinado y una operativa determinada para que el/la asistente, en caso de cancelación o anulación del Festival, pueda solicitar la devolución a la plataforma de venta de entradas donde haya adquirido la entrada, conforme a la legislación vigente en dicho momento. Para proceder a la devolución indicada será necesario acreditar que el/la usuario/a ha adquirido una entrada del Festival a través de las vías oficiales de venta.

2. Puntos de venta de entradas oficiales:

Las entradas sólo podrán ser adquiridas en puntos de venta expresamente autorizados por la Organización. La Organización no se hace responsable de las entradas que no se hayan adquirido en los puntos de venta oficiales.

Los puntos de venta oficiales son:

El importe de las entradas del Festival que el usuario adquiere en los puntos habilitados no incluye los costes de gestión, importe que se indicará en el momento del proceso de compra y es un coste determinado por la plataforma de gestión de venta de entradas contratada por la organización.

Dichos costes de gestión que los canales de venta aplican al precio de las entradas y cobran directamente a los usuarios por su servicio no será devuelto por la Organización al ser dicho importe ajeno a Festival Veranos del Taoro y se  corresponde a un servicio generado y prestado al usuario en la adquisición de la entrada y el pago de la misma, cubriendo gastos implícitos en la programación, servidor, pasarela de pago y atención al cliente en el servicio de venta.

Cualquier otro gasto adicional originado relacionado con la asistencia, contratados por el asistente por su cuenta tales como: alojamientos, vuelos, taxis, seguros, … en caso de cancelación o anulación del Festival no serán sufragados por la Organización en ningún caso.

4. Tipos de entradas:

Ticket por función

Incluye entrada al espectáculo seleccionado al precio determinado en la zona donde se ubique su butaca.

Abono Laurel de Indias GOLD

Este abono incluye:

  • Se aplicará un 15% de descuento sobre el valor total de la compra de las entradas para todos los espectáculos que se representan en el Espacio Laurel de Indias.

  • Las entradas vinculadas al abono estarán situadas en la zona GOLD. Si compras más de un abono, las butacas se ubicarán contiguas. Es importante comprar el número de abonos del grupo completo al mismo tiempo para garantizar que todas las butacas sean correlativas.

  • Una vez comprado el abono, se recibirá vía mail las entradas para las butacas asignadas.

  • El primer día el usuario recibirá en taquilla la GOLD BAG que contiene las entradas para cada día y un pase GOLD.

  • El día de tu elección tendrás una invitación a tapa de jamón ibérico y 1 copa de vino a consumir antes de la función en la zona designada por la organización.

  • Al comprar el abono tendrás una consumición de bebida (agua, refresco o cerveza) en los foodtrucks de nuestra Zona Gastro. Una consumición al día.

  • El vaso reutilizable del Festival no está incluido en la oferta y deberás conseguirlo en los puestos del parque por 1€.

Abono TOTAL

Este abono incluye:

  • Se aplicará un 17% de descuento sobre el valor total de la compra de las entradas para todos los espectáculos indicados en la página del abono.

  • Las entradas vinculadas al abono estarán situadas en la zona PATIO CENTRAL en Laurel de Indias y en la zona GENERAL del espacio Arboleda. Si compras más de un abono, las butacas se ubicarán contiguas. Es importante comprar el número de abonos del grupo completo al mismo tiempo para garantizar que todas las butacas sean correlativas.

  • El primer día el usuario recibirá en taquilla la ABONO BAG que contiene las entradas para cada día y función.

  • Una vez comprado el abono, se recibirá vía mail las entradas para las butacas asignadas.

  • Al comprar el abono tendrás una consumición de bebida (agua, refresco o cerveza) en los foodtrucks de nuestra Zona Gastro. Una consumición al día.

  • El vaso reutilizable del Festival no está incluido en la oferta y deberás conseguirlo en los puestos del parque por 1€.

5. Derecho de admisión:

El/La usuario/a se compromete a disponer de la entrada de manera que pueda ser leída en el control electrónico de validez del código impreso en ella, a efectos de la facilitación y agilización de la admisión y la entrada al Festival en los controles de acceso. El personal de la Organización realizará un control del código de la entrada para acceder a cada uno de los recintos en los que se requiera acceso con entradas.

En virtud de lo dispuesto en la Ley 17/1997, de 4 de julio, de Espectáculos Públicos y Actividades Recreativas, el derecho de admisión se utilizará por parte de la Organización como eficaz instrumento para impedir la violencia y las alteraciones del normal desarrollo del festival, así como cualesquiera otras situaciones que pudieran suponer un peligro real y grave para los usuarios asistentes al evento.

El ejercicio del derecho de admisión no podrá conllevar, en ningún caso, discriminación por razón de nacimiento, raza, sexo, religión, opinión, discapacidad, orientación sexual, identidad de género o cualquier otra condición o circunstancia personal o social de los usuarios de los establecimientos y los espacios abiertos al público, tanto en lo relativo a las condiciones de acceso como a la permanencia en los establecimientos y al uso y goce de los servicios que se prestan en ellos.

Lo anterior no implica que la admisión al Festival sea automáticamente denegada en dichos supuestos, ni a la totalidad de la duración del Festival, sino en aquellos casos que puedan suponer un peligro real y grave para los usuarios asistentes al Festival y para la propia celebración del Festival en sí mismo, mientras perduren dichas actitudes o circunstancias.

6. Acceso al Festival:

La Organización del Festival podrá denegar el acceso a aquellas personas que porten una entrada falsificada reservándose la Organización el derecho a emprender las medidas legales mencionadas en el punto 10. Se entiende por entrada falsificada todo aquel documento creado o modificado, con el fin de hacerlo pasar por verdadero o alterar su validez.

La entrada dispone de diferentes medidas de seguridad. La Organización no se hace responsable de las entradas que no se hayan adquirido en los puntos de venta oficiales mencionados en estas condiciones generales de venta de entrada.

Toda entrada deberá ostentar las condiciones mínimas para poder pasar el control de acceso al Festival de manera que pueda ser leída en el control electrónico mediante la validez del código impreso en la misma, tal y como se establece en el párrafo anterior.

La Organización del Festival no asume ninguna responsabilidad en caso de pérdida, robo, hurto de la entrada. El/la comprador/a de la entrada o la persona a nombre de la cual se personaliza la entrada asume toda responsabilidad en caso de que su entrada se presente por duplicado, perdiendo todos los derechos que esta le otorga para poder acceder al Festival.

Al entrar al recinto, el público puede estar sujeto a un registro conforme a las disposiciones legales vigentes, no permitiéndose la entrada de objetos que puedan ser considerados peligrosos por la Organización o que estén prohibidos por la normativa vigente:

  • Cualquier objeto que pueda causar un daño a la integridad física de los asistentes, como objetos punzantes o contundentes, objetos de cristal, botellas, armas blancas o de fuego, explosivos, material pirotécnico, punteros láser, sprays, aerosoles, palos selfie, palos de banderas, cascos de moto, ...

  • Cualquier objeto u elemento que se considere pueda perturbar, perjudicar o impedir el normal desarrollo de la actividad.

  • Cámaras fotográficas profesionales, de vídeo o grabadoras, drones.

  • Maletas o bolsas de grandes dimensiones.

Quedan exceptuados de la lista anterior, las muletas, bastones o medios análogos, sólo en caso de personas que por razón de movilidad deban acceder al recinto con dichos medios para poder desplazarse. Así como aerosoles o objetos análogos necesarios por prescripción médica. Estas excepciones deberán ser debidamente acreditadas mediante prescripción o acreditación médica para permitir el acceso al recinto con los mismos. Así mismo será indispensable llevar consigo en todo momento el documento nacional de identidad o a los asistentes de nacionalidad no española documentos que acrediten la identidad de sus países de origen (NIE, pasaporte, …).

Solo será válida la primera entrada que sea presentada y validada. Cualquier entrada con el mismo código, que sea presentada posteriormente, será inválida sin que la Organización pueda hacerse responsable. Por ello, aconsejamos no publicar tu entrada en redes sociales ni imprimirla en lugares inseguros y no facilitar los datos de tu entrada a otras personas.

7. Seguridad y salud dentro del Festival:

La Organización confirma que cumple con la legislación actual en materia de seguridad. Cuenta con medidas y personal para garantizar la seguridad de todos los asistentes.

Cualquier tipo de agresión, robo o conducta delictiva deberá ser puesta en conocimiento inmediato del personal de Seguridad, quienes se encargarán de tomar las medidas oportunas.

La Organización no se hará responsable ni directa ni indirectamente de las agresiones, robos, hurtos, etc., que en su caso se produzcan dentro del recinto o en las inmediaciones. Éstas deberán ser denunciadas ante las autoridades competentes.

Existirá un punto de “objetos perdidos” dentro del Festival ubicado en la taquilla. Una vez finalizado el mismo todos los objetos serán llevados por la Organización a la Comisaría más cercana del Recinto.

En los recintos con venta de entradas no estará permitido el acceso con comida y bebida.

La adquisición de bebidas únicamente se podrá realizar en las barras habilitadas a tal efecto, con la prohibición de venta de bebidas alcohólicas a menores de 18 años.

8. Limitación de aforo:

Los recintos del Festival tienen un aforo limitado legal establecido como aforo máximo. Laurel de indias: 594 pax / Arboleda: 150 pax

9. Edad mínima y menores de edad

 

No está permitida la entrada a los recintos con venta de entrada a  menores de 3 años.

10. Prohibición de reventa de entradas:

Está prohibida la reventa de cualquier entrada. Todas las entradas adquiridas en los puntos de venta oficiales de Festival Veranos del Taoro mediante tarjeta bancaria o PayPal son a título nominativo, lo que otorga el derecho a acceder al festival al/la comprador/a de la entrada como titular de la misma, independientemente de que no se indiquen los datos del titular en la propia entrada.

En todo caso, el/la comprador/a original de las entradas podrá cederlas a sus allegados/as (familiares, amigos, compañeros de trabajo, etc.) siempre que: 1. el/la asistente portador de la entrada pueda acreditar su identidad y su relación personal con el/la comprador/a; 2. dicha cesión sea gratuita o mediante el mero reembolso de su precio no incrementado; y 3. que la cesión se realice directamente sin intervención de intermediarios, páginas de reventa o de venta de segunda mano, etc.

La Organización podrá someter las entradas a un control de identidad del portador, ya sea mediante los lectores QR de acceso al festival o mediante otros medios de identificación.

Debido a la prohibición de la reventa, todas las entradas para el Festival Veranos del Taoro adquiridas en cualquier canal de reventa, de segunda mano, puntos de venta no oficiales, etc son fraudulentas. En consecuencia, en caso de que un/a comprador/a revenda alguna entrada de forma no autorizada, todas las entradas adquiridas por éste/a perderán todos los derechos asociados a las mismas, incluido el acceso al festival, sin derecho al reembolso del importe satisfecho por ellas. La Organización del festival podrá anularlas y volver a ponerlas a la venta.

Adicionalmente, sin perjuicio de las posibles responsabilidades civiles y/o criminales y posteriores reclamaciones por los daños y perjuicios generales causados a Festival Veranos del Taoro, el/la revendedor/a deberá indemnizar a la Organización en todos los daños y perjuicios que dicha reventa no autorizada pudiera causarle.

11. Prohibición del uso de las entradas con fines publicitarios:

La posesión de esta entrada no da derecho a su poseedor o a terceros a utilizar la misma, o su contenido, con fines publicitarios, de marketing o de promoción (incluidos sorteos, concursos y/o regalos) asociada al poseedor de la entrada o tercero, sin el previo consentimiento de Festival Veranos del Taoro.

El incumplimiento de este punto facultará a la Organización a ejercer aquellas acciones civiles, penales y/o administrativas que según derecho le correspondan frente al anunciante y/o usuario no autorizado, sin perjuicio de posteriores reclamaciones por los daños y perjuicios generales causados a Festival Veranos del Taoro, debiendo indemnizar a la Organización de todos los daños y perjuicios que dicho uso no autorizado pudiera causarle.

12. Derechos de propiedad intelectual e industrial:

El público asistente reconoce y acepta que la Organización ostenta y es titular de todos los derechos de propiedad intelectual e industrial, derivados, directa o indirectamente, de las representaciones y actuaciones artísticas o cualesquiera otras que tuvieran lugar con motivo de la celebración del Festival, sin limitación territorial ni temporal, y sin ninguna otra limitación más que las dispuestas en la vigente Ley de Propiedad Intelectual.

En consecuencia, queda terminantemente prohibida, para su publicación o difusión con fines comerciales o publicitarios, la captación, fijación o grabación de imágenes o sonidos sin la previa autorización escrita de la Organización. Únicamente la captación de imágenes o grabaciones se permite para un uso exclusivo privado y personal del usuario.

El público asistente reconoce y acepta que podrá aparecer en imágenes y/o grabaciones tomadas por diferentes medios para la posterior difusión y/o publicidad del Festival a través de cualquier medio con fines informativos, promocionales y/o comerciales del Festival Veranos del Taoro, y acepta dicho uso por parte de la Organización.

Se informa de que dichas imágenes podrán tener la condición únicamente de accesorias, panorámicas, fotografías generales o de interés público, y similares, así como las expresamente pactadas con el/la usuario/a, entendiéndose por éstas las entrevistas realizadas al/la usuario/a y consentidas por este/a. En ningún caso se realizará un primer plano de una o varias personas para los fines aquí descritos sin el consentimiento de las mismas.

El público asistente, por tanto, autoriza a la Organización a la utilización y explotación de las imágenes y/o grabaciones mencionadas que puedan realizarse únicamente durante la celebración del Festival y la posterior difusión de las mismas a los efectos indicados en los párrafos anteriores.

Todo ello sin perjuicio de la posibilidad que asiste a los/as usuarios/as de ejercitar los derechos correspondientes de acceso, rectificación, supresión, limitación del tratamiento, portabilidad y oposición. 13. Protección y tratamiento de datos personales:

De acuerdo con lo establecido por las normativas vigentes en protección de datos personales, el Reglamento (UE) 2016/679 de 27 de abril de 2016 (RGPD) y la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD), se informa que tus datos serán tratados bajo la responsabilidad de la Organización y podrán ser utilizados para gestionar tu participación en los eventos, actividades, sorteos y cualquier otra actividad que dependa de Encaro Factory SL así como para ser informado de cuestiones relativas a la organización.

Con la adquisición de la entrada muestras tu consentimiento a que los datos facilitados sean tratados por Encaro Factory SL, sin perjuicio de los derechos que legalmente te asisten como usuario (derecho de acceso, rectificación, supresión, limitación del tratamiento, portabilidad y oposición). 

14. Hojas de reclamaciones

La Organización tendrá hojas de reclamaciones en el modelo oficial a disposición del público del Festival Veranos del Taoro en los lugares previstos por la normativa vigente en caso de que las solicitasen.

15. Reserva legal

Todos los intentos de estafa, allanamiento y/o por daños a la propiedad privada causados directa o indirectamente a la Organización, autorizan a esta a tomar las medidas legales, tanto civiles como penales que estime oportunas contra los causantes.

Así mismo La Organización puede ampliar, eliminar o modificar cualquiera de las anteriores condiciones e informar si fuera necesario mediante los canales que, según el motivo, considere adecuados
